By downloading, installing, or using the Beans mobile application ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Description of Service

Beans is a mobile application for iOS devices that helps users discover nearby coffee shops. The App provides:

• Location-based search for coffee shops
• Coffee shop information including ratings, photos, hours, and contact details
• Interactive map display of nearby locations
• Filtering and customization options
• Integration with third-party map services for navigation

3. License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App for personal, non-commercial purposes.

4. User Requirements

To use the App, you must:

• Have an iOS device running iOS 17.0 or later
• Grant location permissions ("When In Use")
• Have an active internet connection
• Be at least 13 years of age (or the minimum age required in your jurisdiction)

5. Acceptable Use

5.1 Permitted Use

You may use the App to:

• Discover and find information about coffee shops
• View coffee shop locations on maps
• Access contact information and hours of operation
• Navigate to coffee shop locations

5.2 Prohibited Use

You may NOT:

• Use the App for any illegal or unauthorized purpose
• Attempt to reverse engineer, decompile, or disassemble the App (except as permitted by law)
• Use automated systems or bots to access the App
• Attempt to overwhelm or disable our services or third-party APIs
• Remove, obscure, or alter any legal notices in the App
• Use the App to harass, abuse, or harm others
• Collect data from the App for commercial purposes without permission

6. Third-Party Services

6.1 APIs and Data Providers

The App uses third-party services to provide functionality:

• Google Places API: For coffee shop data and information
• Foursquare API: Alternative source for coffee shop data
• Apple MapKit: For map display and navigation
• Google Maps: Optional navigation service

Your use of these services is subject to their respective terms of service and privacy policies. We are not responsible for the content, accuracy, or availability of third-party services.

6.2 Third-Party Links

The App may contain links to third-party websites or services (e.g., coffee shop websites, phone numbers). We are not responsible for the content, policies, or practices of these third parties.

7. Content and Accuracy

7.1 Third-Party Content

All coffee shop information (names, addresses, ratings, photos, hours, etc.) is provided by third-party services (Google Places, Foursquare). We do not create, verify, or guarantee the accuracy of this information.

7.2 No Warranty of Accuracy

Coffee shop information may be outdated, incomplete, or inaccurate. Hours of operation, ratings, and other details may change without notice. Always verify critical information directly with the business.

7.3 User Responsibility

You are responsible for verifying the accuracy of information before relying on it. We recommend contacting businesses directly to confirm hours, availability, and other important details.

8. Location Services

The App requires access to your device's location services to function. By granting location permission, you acknowledge that:

• Your location will be used to find nearby coffee shops
• Your location may be sent to third-party services (Google Places, Foursquare)
• Location is only accessed when the App is in use ("When In Use" permission)
• You can revoke location permission at any time through iOS Settings

9. Intellectual Property

9.1 App Content

The design, layout, graphics, and user interface of the App are owned by Florent Votte and protected by copyright and other intellectual property laws.

9.2 Third-Party Content

Coffee shop photos, names, ratings, and other data are owned by their respective owners and providers (Google, Foursquare, individual businesses). We claim no ownership of third-party content.

9.3 Trademarks

"Beans" and the Beans logo are trademarks of Florent Votte. Google, Google Places, Foursquare, Apple, and other third-party names are trademarks of their respective owners.

10. Disclaimers

10.1 "As Is" Basis

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy or completeness of content
• Uninterrupted or error-free operation

10.2 No Professional Advice

The App provides informational content only and does not constitute professional advice. We are not responsible for decisions you make based on information from the App.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FLORENT VOTTE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or property damage
• Errors or inaccuracies in third-party content
• Unavailability or interruption of the App or third-party services
• Any damages arising from your use or inability to use the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED €10 (TEN EUROS) OR THE EQUIVALENT IN YOUR LOCAL CURRENCY.

12. Indemnification

You agree to indemnify, defend, and hold harmless Florent Votte from any claims, damages, liabilities, costs, or expenses (including reasonable attorneys' fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of applicable laws or regulations

13. Changes to the App

We reserve the right to:

• Modify, suspend, or discontinue the App at any time
• Change features, functionality, or design
• Update system requirements
• Change or remove third-party integrations

We will make reasonable efforts to notify users of significant changes through app updates or in-app notifications.

14. Changes to Terms

We may update these Terms from time to time. Changes will be effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the updated Terms. We will update the "Last Updated" date at the top of this document.

15. Termination

15.1 By You

You may stop using the App at any time by deleting it from your device.

15.2 By Us

We may terminate or suspend your access to the App if you violate these Terms or for any other reason at our discretion.

15.3 Effect of Termination

Upon termination, you must stop using the App and delete it from your device. Sections of these Terms that should reasonably survive termination will remain in effect.

16. Free Service

Beans is provided free of charge. There are no in-app purchases, subscriptions, or fees. We reserve the right to introduce fees or paid features in the future with advance notice.

17. Availability

The App is currently available for iOS devices through direct distribution. Availability may vary by region and is subject to change. We do not guarantee continuous availability or support.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to its conflict of law provisions. Any legal action or proceeding arising from these Terms shall be brought exclusively in the courts of France.

19. Dispute Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at florent@votte.eu. We will attempt to resolve disputes in good faith.

20. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. Invalid provisions shall be modified to the minimum extent necessary to make them valid and enforceable.

21. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Florent Votte regarding the App and supersede all prior agreements and understandings.

22. No Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

23. Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
